District Judge Dennis Silver in the United States delayed the implementation of new visa policies set by the Trump administration to limit the duration of stay for foreign students and journalists in the country on Monday. This temporary order was issued one day before the scheduled enforcement of the new rules by the Department of Homeland Security (DHS).
Details of the New Visa Rules
Under the proposed rules, foreign students on student visas can only stay in the United States for a maximum of four years, after which they must apply for a visa extension. Previously, these students were allowed to remain for the duration of their studies in the country. Additionally, foreign journalists will be allowed to stay for 240 days, equivalent to about eight months, and can apply for a visa extension. Until now, these journalists could stay for a maximum of five years in the United States.

For Chinese journalists, the duration of stay has been reduced to 90 days, which can be extended for a similar period. These changes in visas are part of a series of new immigration restrictions implemented as part of President Trump's hardline policies.
Legal Challenges and Concerns
A coalition of university unions, teachers, and journalists has taken legal action to challenge these visa restrictions. Judge Silver suspended the enforcement of the new DHS rules in his ruling and scheduled another hearing for October 2. In a note accompanying the ruling, he expressed doubts about the visa restrictions on international students and journalists, stating that the current system has allowed millions of foreign students to enroll, leading to advanced research in science, medicine, and technology and significant economic growth.
Judge Silver noted that under the new rules, the denial of visa extension applications would be entirely discretionary and non-reviewable. He added that a DHS official would have the power to terminate the academic, research, or teaching activities of any non-U.S. citizen based on limited and vague criteria, without the possibility of appeal.
Furthermore, foreign journalists applying for visa extensions will have no recourse for appeal if their application is denied. Judge Silver stated, "The potential for abuse in this area is very high, particularly the likelihood of visa extensions not being granted for foreign journalists who criticize the government." He also remarked that the DHS's argument for national security necessity to justify these rules is "reasonably unreasonable."
In the 2023-2024 academic year, the United States welcomed over 1.1 million international students, more than any other country. This statistic reflects the appeal of the United States to international students and the far-reaching implications of these changes on attracting foreign talent in the future.
